Update No 2: Signaller Back Pay Claim Dispute

Non Payment of Time Worked at 150% when called in with less than 24 hours Notice
On Thursday 18th February 2016, the RTBU met with Sydney Trains in relation to the back pay claim dispute. The basis of the meeting was due to Sydney Trains IR informing the RTBU that they were not prepared to authorise the backpay claim. There was no further explanation or time frame given in regards to Sydney Trains change in position.
The RTBU informed Sydney Trains that they do not believe that the membership will find their position acceptable but will seek the guidance from the membership.
After speaking with a number of delegates it was decided that the RTBU would request the membership lodge step 3 dispute notifications on an individual basis.
The membership was quick to respond to the call to arms and over 110 step 3 disputes were lodged within 48 hours. This resulted in Sydney Trains requesting a ‘cease fire’ by Friday 19th February 2016. In addition, Sydney Trains rapidly organised a meeting to be organised between the RTBU and Sydney Trains
The RTBU met with Sydney Trains on Monday 22nd February 2016 where Sydney Trains outlined the delay was due to ensuring that any money owed was paid within the constraints of the EA taking into consideration clauses 114.2, 118.5 and 112. It must be noted that the RTBU never had any expectations of Sydney Trains breaching the EA.
As a consequence Sydney Trains have confirmed that they will have finalised the numbers and provided a response no later than Wednesday the 23rd March 2016.
In addition, the RTBU has secured the release of David Bradney to be released to assist payroll for the purposes of being able to assist in the event that there are some questions raised during this process.
The RTBU would like to thank all the members that acted so quickly with lodging the disputes in such a short timeframe.
