Pacific National advised of Protected Industrial Action – NSW VIC EA Employees

The RTBU again met with Pacific National last Friday. In a good faith attempt to progress an agreement the RTBU reconsidered a number of items from our log of claims. We asked that Pacific National consider these over the weekend and report back to us by midday today.

On Friday night Pacific National responded by email and advised the following;

“Whilst PN does acknowledge that we have made some progress, and also acknowledge the concessions made by the RTBU today, I think we can both agree that we remain a long way apart on some very material issues.
“As discussed, Many of the claims the RTBU is proposing PN regards as unreasonable and do not consider we can reasonably accept. Just to name a few:

  • Meal breaks,
  • RDOs above 104,
  • 1 in 3 weekends off duty, protections for leave,
  • payment for sleep in barracks; and shift lengths”

They also advised they could not reasonably consider our proposals until close of business Thursday.

As you are all aware members recently, strongly endorsed Protected Industrial Action and today the RTBU on your behalf has advised Pacific National of our intention to take protected industrial action. We have advised Pacific National a ban on working overtime will be implemented from midnight Friday night and will continue indefinitely.

What does this mean? Members should from midnight Friday night, refuse to work any overtime they are;

  1. Requested to perform
  2. Rostered to perform
  3. Any additional hours above their allocated duty cycle

Members should also be aware that any inducement payment offered as overtime rates to perform a particular task is not overtime (ticking the box) however we strongly encourage members to think before accepting these type of arrangements in any case as by doing so you may well be in breach of the enterprise agreement.

The RTBU has also requested that Pacific National agree to meet next week in an attempt to progress negotiations.

Members will be updated of progress as it happens.
